Vuse Menthol Pods Receive Stay from Appellate Court

Reynolds Vapor Co. received a marketing denial order (MDO) for two mint Vuse flavors that can continue to be marketed by R.J. following a stay order from the 5th U.S. Circuit Court of Appeals.

Last week (April), the FDA rejected Reynolds Vapor’s premarket tobacco product applications, Vuse Refills Menthol 4.8% G1 and Vuse Refills Menthol 4.8% G2.

As a result, Reynolds would be prohibited from marketing or distributing the product domestically or risk an FDA enforcement action. However, the appeals court decision allowed the product to remain on the market.

Last October, the FDA issued MDOs for several mint-flavored e-cigarette products sold by Logic Technology Development. This is the first MDO issued by the FDA for a menthol product after undergoing scientific review.

The order comes days after Logic obtained a court order from the U.S. Circuit Court of Appeals for the Third Circuit.
